What if the USPTO suspends my pending trademark application?

If the USPTO suspends your application, it will become temporarily paused because a similar earlier application is pending and the examiner is waiting to see its outcome before proceeding with yours.

No response is typically required from the applicant during a suspension; it is an administrative hold. The USPTO will notify you when the suspension is lifted and examination resumes. The application remains active during the suspension period.

If the earlier conflicting application is ultimately refused or abandoned, the suspension on your application is lifted, and examination continues. If it proceeds to registration, the USPTO may then issue a likelihood of confusion refusal against your application.
